More than 100 workers are currently challenging the Victorian Government’s mandatory vaccination orders in the Supreme Court of Victoria, on the basis that the Public Health Directions breach the State’s Charter of Human Rights and Responsibilities.

The workers come from a range of industries including health, construction, and education, and are concerned that they face losing their jobs if they make the decision not to comply with the mandatory vaccination requirements.

At this stage it is unknown which sections of the Charter the litigants plan to rely on in presenting their arguments.

If you are interested in keeping track of this matter, Simon Harding Ors v Brett Sutton Ors, is streaming the hearing right now (3 November 2021) which can be viewed here.
